e-Tips and Traps: Is Connecticut ready for new e-discovery rules?
Connecticut state courts leap into the modern world on Jan. 2, 2012 with the implementation of new electronic discovery rules.
In theory, this will make it easier for victims of medical malpractice or corporate wrongdoing to secure “smoking gun” evidence. As with any cases, a lot will depend on the competence of judges and litigators. Still more critical in this rapidly-evolving arena could be the experts hired by opposing parties to either ferret out hidden evidence or demonstrate good faith in the evidence production.

Koskoff Attorney Craig Smith Settles Hand Injury Case
After five years of litigation, attorney Craig Smith of Koskoff, Koskoff & Bieder has been able to resolve a case on behalf of a client for approximately $2 million on the first scheduled day of trial. The manufacturer agreed to a settlement for injuries sustained by KKB client while she was using the manufacturer’s product. The terms of the resolution and circumstance, as well as the parties’ identities must remain confidential as part of the settlement agreement. The injury, however, involved a crushed hand that resulted in nerve damage. The client became unable to use the injured hand and underwent extensive treatment and several surgeries to try to repair it; however, her hand ultimately remained permanently disfigured. In a statement after the settlement, attorney Smith said “I am glad that we were able to resolve the case for the client, who has suffered immeasurably from this injury for too long. You don’t realize how devastating a hand injury can be until you see the impact on a person’s daily life. Having a painful hand can be even worse at times than having lost a hand because of the chronic pain component that just never goes away. We are happy that we have been able to play a role in bringing some justice to this client and, hopefully, some closure.”
